The criminal justice system is exploring how we can make use of ‘remote participation’ technology (i.e. appearing by video link) in our hearings. Remote participation has the potential to improve the experience of participants, increase access to justice, and improve efficiency. If used on the wrong occasions, or for someone who can’t participate as well remotely, or done poorly, it also risks an unfair and unjust hearing. The considerations are particularly acute in relation to defendants held in custody.
Judge Nicholls will give an overview of the current approach and trends, and the current practical challenges in assessing whether remote participation is a fair or better mode of appearance for a defendant. The potential for experts to appear remotely will also be covered. Discussion and sharing of experiences will be welcome.
